§ 1 General information

All orders placed via the aforementioned website, as well as deliveries and services on our part, are subject exclusively to the following General Terms and Conditions in the version valid at the time of the order. We do not recognize any terms and conditions of the customer that contradict or deviate from these terms and conditions unless we have agreed to their validity in writing. This shall apply even if we deliver the goods without reservation in the knowledge of conflicting terms and conditions of the customer.
§ 2 Cancellation policy
Right of withdrawal
You have the right to cancel this contract within 14 (fourteen) days without giving any reason.
The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

1. the goods offered at michaeljondral.com are shown on the website in the form of digital photographs based on the actual goods. Minor deviations between representation and reality do not constitute a defect in the goods ordered.
2. we would like to point out that the products presented on michaeljondral.com may no longer be available or available at the time of visiting the website and that the corresponding prices may have changed. The prices shown are in euros, including VAT and excluding shipping costs.
3 JONDRAL GmbH & Co KG is entitled to make partial deliveries.
§ 4 Conclusion of contract
1. a contract between you and JONDRAL GmbH & Co KG is only concluded when the ordered goods are sent to you by us. Silence or inactivity on our part does not constitute a declaration of contract. You submit a binding offer to us to conclude a contract with us for the respective product at the moment you send the order form provided on our website ("your contractual declaration"). You place the order when you have entered all the information during the ordering process and finally send the order form to us by clicking the "Buy now" button.
2 JONDRAL GmbH & Co KG is entitled to reject an offer without justification, in particular if there is reason to suspect that the goods purchased via our website are to be resold commercially. The sending of an order confirmation by us does not constitute a contractual declaration.
§ 5 Storage of the contract text
Your order data will be stored by us. You will receive an order confirmation including the specified data by e-mail, which you can in turn print out via your account.
§ 6 Delivery & shipping
1 JONDRAL GmbH & Co KG ships its products within Germany by UPS, DHL Paket or DHL Express. The transportation risk is borne by the sender. Deliveries to all other countries are made exclusively by DHL.
2. the goods are ready for dispatch on the day following your order at the latest. Unless otherwise agreed with you, delivery will be made from the warehouse within 1-5 working days to the delivery address you specify, depending on the choice of shipping method and delivery location. However, any obstacles may result in delays of up to seven days.
3. shipping costs:
Within Germany: UPS shipping from 500.00 € value of goods free shipping (up to 499.99 € shipping is 7.00 €)
EU: DHL Express shipping from 500.00 € value of goods free shipping (up to 499.99 € shipping is 17.00 €)
Switzerland: DHL Express shipping from 500.00 € value of goods free shipping (up to 499.99 € shipping is 45.00 € with DHL Express)
NON-EU: DHL Express shipping from 800.00 € value of goods free shipping (up to 799.99 € shipping is 45.00 € with DHL Express)
For partial shipments, the shipping costs are only charged once.
4. dutiable shipments:
The delivery time to countries subject to customs duties is two to four working days. We would like to point out that we bear the costs for door-to-door transportation, insurance of the goods and any costs for accompanying documents. If DDP (Duties Delivered Paid) is possible, any import sales tax and customs duties will be charged to the recipient at checkout; if this is not possible (DDU = Duties Delivered Unpaid), these will be due on delivery and will be charged to the customer. Please note that any foreign bank charges are to be borne by you. For all deliveries to third countries, the prices quoted for the items are net prices.
§7 Payment, late payment
When paying for your order at michaeljondral.com, you have the option of choosing between Paypal and credit card.
Procedure for payment by credit card:
1. you first enter your credit card details in our SSL-secured payment form.
2. after successful credit card verification by the credit card company, the invoice amount is first authorized, i.e. reserved on your credit card but not yet debited.
3. your order will be processed within the delivery period specified at § 6
4. the payment is booked when the goods are dispatched.
Due to this automated process, the correctness and security of the transaction can be guaranteed.
Note: Credit notes from returns will be credited back to your credit card.

§ 8 Retention of title
We reserve title to the purchased item until all payments arising from the customer relationship and the delivery contract have been received. If the customer acts in breach of contract, in particular in the event of default of payment, we shall be entitled to take back the purchased item. If we take back the purchased item, this shall constitute a withdrawal from the contract. After taking back the purchased item, we shall be authorized to sell it; the proceeds of the sale shall be set off against the customer's liabilities - less reasonable selling costs.

Collection, processing and use of personal data
In all data processing operations (e.g. collection, processing and transmission), we proceed in accordance with the statutory provisions. § 13 Liability
Customer claims for damages are excluded. Excluded from this are claims for damages by the customer arising from injury to life, limb or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract. In the event of a breach of material contractual obligations, the provider shall only be liable for foreseeable damage typical of the contract if this was caused by simple negligence, unless the customer's claims for damages are based on injury to life, limb or health. The restrictions also apply in favor of the legal representatives and vicarious agents of the provider if claims are asserted directly against them.
The provisions of the Product Liability Act remain unaffected.
§ 14 Choice of law, effectiveness, place of performance, place of jurisdiction
1 German law shall apply exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the country in which the customer has his habitual residence shall remain unaffected.
2. should one or more provisions be invalid, this shall not affect the validity of the remaining provisions.
The place of performance for all our obligations is Hanover.
For all disputes between the parties - insofar as they are merchants - the courts responsible for Hanover are agreed as the exclusive place of jurisdiction.
